The Economic Offences Wing (EOW) of Mumbai police registered a complaint against a builder, who cheated 10 people to the tune of INR 1.57crore by selling them flats on unauthorised floors of a building at Malad (East).
“A case under sections of Indian Penal Code (IPC) and Maharashtra Ownership Flats Act (MOFA) has been registered against Shrenik Jain, director of Bahubali Estate Private Limited,” an EOW officer said.
The complainant Rajiv Tulsayan said that in 2004, Jain showed him brochures and promised him flats on the seventh floor of Dhruv Heights in Malad (East). In 2006, he handed over possession of the flat.
Later, it was revealed that the builder had illegally constructed the sixth and seventh floors as he did not have the required clearances from civic authorities.
“He has cheated nine other people,” said Tulsayan.
Another victim, Abhishekh Shah said, “Jain said that he had Transfer of Development Rights (TDR) and would get the two floors regularised. However, he never did. In December 2017, the owners received notices from the BMC about illegal construction, which would be demolished if not regularised. They then moved to Bombay HC and also filed a criminal case against him.
When contacted Shrenik Jain, said, “I had told them that I would utilise TDR and get the two floors regularised, but some technical issues occurred. I offered to return the money in 15 days, but they didn’t come. I have made a submission before the judge saying that I will regularise the two floors.”
